Terms of Trade

- Definitions
1.1 “Company” refers to WaterCrafts Plumbing Limited.
1.2 “Client” refers to the individual, homeowner, landlord, or business engaging the Company’s services.
1.3 “Engineer” refers to the Company’s representative attending the site to carry out the agreed works.
1.4 “Service” refers to any plumbing, heating, electrical or related work provided by the Company. 1.5 “Invoice” refers to the formal request for payment issued by the Company.
1.6 “Report” refers to any written documentation, findings, or recommendations provided by the Company following completion of works.
1.7 “Credit Terms” refers to any agreed arrangement allowing the Client to pay after services have been delivered, subject to prior approval.

- General Terms
2.1 Scope of Services – These terms apply to all services provided by WaterCrafts Plumbing Limited.
2.2 VAT – All charges are subject to VAT at the prevailing rate unless otherwise stated.
2.3 Communication – We will communicate with clients primarily via telephone, WhatsApp, or email. Please ensure your contact details are accurate and up to date.

2.4 Quotations & Charges – Any quotations provided are estimates only. Final charges may vary depending on the actual work carried out.
2.5 Cancellation Policy – Bookings cancelled with less than 24 hours’ notice may be subject to a cancellation fee.
2.6 Liability – While every effort is made to deliver services safely and professionally, we accept no liability for delays or issues arising from circumstances beyond our control (e.g., access restrictions, parking availability, unforeseen site conditions).

- Parking and Congestion Requirements
3.1 Due to the size and weight of our equipment, easily accessible parking within 100 metres of the site address is required.
3.2 Where necessary, parking permits should be provided by the client.
3.3 Any parking fees or fines incurred by our company will be charged at cost.
3.4 Congestion charges will be applied if the property/route is located within the low emissions zone.

- Waste Removal
4.1 Pricing assumes any waste created will be bagged and left on site.

4.2 If you require non‑metallic waste to be taken away and disposed of, this will incur an additional charge of £35.00 per rubble sack.

- Listed Buildings and Heritage Properties
5.1 The Client is responsible for ensuring that all necessary consents, approvals, and permissions have been obtained prior to commencement of works.
5.2 The Company will not be liable for delays, costs, or penalties arising from the Client’s failure to secure such permissions.
5.3 Any additional requirements imposed by local authorities, conservation officers, or heritage bodies must be communicated to the Company in writing before works begin.
5.4 The Company reserves the right to adjust quotations, schedules, or methods of work to comply with listed building regulations and conservation requirements.
5.5 Where specialist materials or techniques are required, these may incur additional costs which will be invoiced to the Client.
5.6 The Company accepts no liability for damage to historic fabric or features where such damage is unavoidable due to the nature of the works, unless caused by proven negligence.

- Payment Terms – Private Individuals / Homeowners (Excludes Landlords)
6.1 Payment Due – Payment is required on completion of works.
6.2 Works over £1000 – Subject to a 40% deposit required prior to works commencing once estimate is accepted.

6.3 Accepted Methods – We accept all major debit/credit cards (excluding American Express), cheques, and bank transfers.
6.4 Card Payments – Payments may be collected by the attending engineer on site or via a secure payment link sent by WhatsApp or email.
6.5 If You Are Not Present –
6.5.1 We will attempt to contact you by telephone to arrange payment.
6.5.2 If we are unable to reach you, an invoice will be sent by WhatsApp/email and payment is strictly due upon receipt.
6.6 Overdue Payments – Outstanding balances may be pursued through formal recovery proceedings via the County Court and/or a debt collection agency. This may result in additional costs including court fees, interest, and legal charges.
6.7 Insurance Payments – We do not accept payment from insurance companies or their representatives.
6.8 Completion Requirement – Full payment must be received before the engineer departs the property.

- Payment Terms – Businesses (Including Landlords)
7.1 Deposits & Bookings –
7.1.1 For reactive works, unless credit terms have been agreed in advance, bookings must be secured with a deposit equal to our minimum hourly charge for the service required.
7.1.2 Payment must be received at least 2 working days before the scheduled booking.
7.1.3 For bookings made within 2 working days, payment is due immediately upon receipt of our proforma invoice.
7.1.4 Provisional bookings may be released if payment terms are not met.

7.2 Additional Charges – Any costs exceeding the minimum hourly charge will be invoiced separately upon job completion, with payment due immediately unless agreed otherwise.
7.3 Deposits – Will not be refunded due to missed appointments by the client or property occupant; a further minimum payment will be required before a new appointment date is issued.
7.4 Overdue Payments – Outstanding balances may be subject to recovery proceedings via the County Court and/or a debt collection agency, incurring court fees, interest, and legal costs.
7.5 Insurance Payments – We do not accept payment from insurance companies or their representatives.
7.6 Reports & Return Visits – Payment must be received in full before any follow‑up or return visits are scheduled.
7.7 Credit Accounts – Repeat business customers may apply for credit terms by contacting us at Info@watercraftsplumbing.co.uk.

- Payment Terms – Long Duration Works
8.1 Deposit Requirement – A deposit of 40% of the total estimated cost is required prior to works commencing.
8.2 Staged Payments – The remaining 60% will be payable in staged instalments, aligned with agreed project milestones or progress updates.
8.3 Payment Schedule –
8.3.1 Staged payment dates and amounts will be confirmed in writing before works begin. 8.3.2 Each staged payment must be received promptly to avoid delays in project delivery.

8.4 Overdue Payments – Any overdue balances may be subject to recovery proceedings via the County Court and/or a debt collection agency, incurring court fees, interest, and legal costs.
8.5 Insurance Payments – We do not accept payment from insurance companies or their representatives.
8.6 Reports & Continuation of Works – Written reports and continuation of works may be withheld until payments are received in accordance with the agreed schedule.

- Mid‑Works Cancellation Terms
9.1 Client‑Initiated Cancellation –
9.1.1 The Company reserves the right to invoice for all labour, materials, and expenses incurred up to the point of cancellation.
9.1.2 Any costs associated with demobilisation or making the site safe.
9.1.3 Deposits paid are non‑refundable.
9.2 Staged Works / Long Duration Projects – Instalments due up to the point of cancellation must be paid in full.
9.3 Remaining Contract Value – The Company may also invoice for a proportion of the remaining contract value to cover loss of time, scheduling, and resources.
9.4 Company‑Initiated Cancellation –
9.4.1 In the unlikely event the Company cancels works mid‑project (e.g., due to unforeseen circumstances beyond our control), the Client will be refunded for any payments made for work not yet carried out.

9.4.2 The Company accepts no liability for delays or costs arising from such cancellation, beyond refunding unearned payments.
9.5 Outstanding Balances – All outstanding balances must be settled immediately upon cancellation.
9.6 Certificates, reports, or documentation will not be released until payment has been received in full.

- Certificates and Reports
10.1 All certificates, reports, and written documentation produced by WaterCrafts Plumbing Limited will be withheld until payment has been received in full (e.g., Leak trace reports, EIC/EICR, Landlord Gas Safety Reports).
10.2 No documentation will be released to the Client until outstanding balances are cleared.
10.3 This applies to all types of work, including private, business, landlord, and long‑duration projects.

- Products Supplied
11.1 Ownership – All products, parts, and materials supplied by the Company remain the property of the Company until payment has been received in full.

11.2 Quality & Standards – Products supplied will be of merchantable quality and fit for their intended purpose, in line with industry standards.
11.3 Manufacturer Warranties – Products supplied are subject to the manufacturer’s warranty only; no additional warranties are provided by the Company.
11.4 Defects & Faults – The Company accepts no liability for defects or failures arising from manufacturer error, normal wear and tear, misuse, negligence, or third‑party interference.
11.5 Client‑Supplied Products – Where the Client requests the use of products or materials supplied by themselves or a third party, the Company accepts no responsibility for suitability, performance, or longevity.
11.6 Additional Costs – Replacement or remedial work required due to defective or unsuitable products (whether supplied by the Company or the Client) may incur additional charges, which will be invoiced accordingly.

- Governing Law & Jurisdiction
12.1 These Terms & Conditions shall be governed by and construed in accordance with the laws of England and Wales.
12.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from these Terms & Conditions.

- Workmanship Guarantee
13.1 WaterCrafts Plumbing Limited guarantees the quality of our workmanship for one (1) year from the date of completion unless stated otherwise.
13.2 Coverage – This guarantee covers defects or faults resulting from:
13.3 Improper installation or construction techniques.
13.4 Poor workmanship or failure to meet agreed-upon standards.
Exclusions:
- This guarantee does not cover:
14.1 Plumbing/Electrical fixtures or fittings (subject to manufacturer’s guarantee/warranty) 14.2 Normal wear and tear.
14.3 Improvised repairs.
14.4 Damage due to misuse, negligence, accident, or third-party interference. 14.5 Defects caused by materials supplied by the client or other contractors. 14.6 Issues resulting from natural events or environmental conditions.
Claim Procedure
To make a claim under this guarantee, please contact us in writing at
info@watercraftsplumbing.co.uk with details of the issue. We will arrange an inspection and schedule necessary repairs if covered by this guarantee.
